  1. Introduction and Commitment to Intellectual Property Protection

Protecting intellectual property is essential to maintaining a lawful and trustworthy digital environment where creators can publish and share content responsibly.

    1.2 Web3 operates as an online content-sharing and streaming platform that enables users to upload, publish, distribute, and interact with multimedia content and related materials. Because the platform hosts user-generated content, we require all users to respect copyright, trademark, and other intellectual property rights when using the Service.

  5. Counter-Notification Procedure

    5.1 If content you uploaded to Web3 has been removed or disabled as a result of a copyright infringement notice and you believe that the removal occurred due to mistake or misidentification, you may submit a counter-notification requesting restoration of the content.

    5.2 A valid counter-notification must identify the material that was removed and the location where the content appeared prior to removal. The counter-notification must also include a statement made under penalty of perjury that the user has a good-faith belief that the material was removed as a result of mistake or misidentification.

    5.3 The individual submitting the counter-notification must also provide their name, address, telephone number, and email address, together with a statement consenting to the jurisdiction of the appropriate courts for the resolution of the dispute. The counter-notification must include a physical or electronic signature of the user submitting the request.

    5.4 Upon receiving a valid counter-notification, Web3 may forward the notification to the complaining party. If the complaining party does not initiate legal proceedings within the timeframe required by applicable law, Web3 may restore the removed material.

    5.5 Web3 does not act as an arbitrator between parties and cannot independently determine ownership of disputed intellectual property rights.

  6. Repeat Infringer Policy

    6.1 Web3 maintains a policy of terminating, in appropriate circumstances, the accounts of users who are determined to be repeat copyright infringers.

    6.2 Users who repeatedly upload infringing content or otherwise violate intellectual property rights may face enforcement measures including content removal, account restrictions, suspension of platform features, termination of monetization privileges, or permanent account termination.

    6.3 Enforcement decisions may consider the nature of the infringement, the user's violation history, the severity of the violation, and the potential harm caused to rights holders or the platform community.

  7. Removal or Restriction of Content

    7.1 Web3 reserves the right to remove, restrict, or disable access to content that appears to infringe intellectual property rights, even in the absence of a formal copyright notice.

    7.2 Such action may be taken when necessary to comply with legal obligations, protect rights holders, maintain platform safety, enforce the Terms of Service or Community Guidelines, or prevent potential harm to users or third parties.

    7.3 Web3 may also temporarily restrict access to content while reviewing reports of potential intellectual property violations.

  8. Misrepresentation and Abuse of the Reporting Process

    8.1 Submitting false or misleading copyright claims may result in legal liability.     9.3 Web3 does not determine whether particular uses qualify as fair use or other legal exceptions and may remove content while disputes between parties are resolved through appropriate legal channels.

  10. Creator Responsibilities

    10.1 Creators using the Web3 platform are responsible for ensuring that all materials included in their content are properly licensed or legally permitted. This includes ensuring appropriate rights for music, images, video clips, datasets, software code, trademarks, and any other materials incorporated into uploaded content.

    10.2 Creators should also understand the implications of licensing agreements, royalty obligations, and platform distribution rights when publishing content on Web3.
